Terms & Conditions

1. General

These Terms & Conditions govern your use of diggerscove.com and your participation in events and activities at Diggers Cove LLC located in Plano, TX. We reserve the right to update these terms at any time. The “Last updated” date above reflects the most recent revision.

2. Admission & Open Play

All visitors must have a signed liability waiver on file before entering the play area. A parent or legal guardian must sign on behalf of minors. Diggers Cove is designed for children ages 1–10. Adults may enter only when accompanying a child.

3. Birthday Party Bookings

• Birthday party sessions are 2 hours in duration.
• A minimum 30-minute gap is maintained between consecutive bookings.
• Maximum 16 children per birthday party session.
• Pricing is as listed on our Birthday Party page and is subject to change. Package pricing and add-ons are confirmed at the time of booking.

4. Deposit & Payment Policy

A $100 deposit is required to secure your birthday party booking. The remaining balance is due in full on or before the day of the event, payable at the store.

Cancellation policy:

• Cancel 14 or more days before your event → full deposit refund
• Cancel 7–13 days before your event → deposit converts to store credit valid for 6 months; no cash refund
• Cancel less than 7 days before your event → deposit is forfeited

Rescheduling:

• One free reschedule is allowed, provided you notify us at least 72 hours before the original event date.
• Rescheduled bookings are subject to availability and must be used within 90 days of the original booking date.
• Reschedule requests submitted less than 72 hours before the event will be treated as a cancellation.

5. Full-Store Bookings

Full-store reservations are available for private events and are booked directly with staff by phone or in person. Full-store bookings are not available for online self-service booking. Deposit and cancellation terms for full-store bookings will be confirmed with you at the time of reservation.

6. Rules & Safety

All visitors must comply with the rules posted in the facility and listed on our Open Play page. Key rules include: adult supervision is required at all times; barefoot play only in the sand area; no food or drinks in the sand area; no running, climbing, throwing, or rough play; use only Diggers Cove toys.

For the health and safety of all children and staff, please keep your child home if they are showing symptoms of illness (fever, runny nose, congestion, or cough).

Diggers Cove reserves the right to remove any visitor who poses a safety risk or violates posted rules, without refund.

7. Liability

Participation in activities at Diggers Cove involves physical activity and inherent risks. By entering the facility, you acknowledge these risks and release Diggers Cove LLC, its owners, employees, and agents from liability for injury, loss, or damage arising from your visit, to the fullest extent permitted by law. A separate liability waiver must be signed before entry.

8. Payments

All online payments are processed securely by Square. Diggers Cove does not store full card numbers. By completing a payment on this website, you agree to Square's terms of service.

9. Intellectual Property

All content on diggerscove.com — including text, images, logos, and branding — is owned by Diggers Cove LLC. You may not reproduce or use any content without prior written permission.

10. Mobile Messaging Terms

The Diggers Cove LLC mobile message service (the “Service”) is operated by Diggers Cove LLC (“Diggers Cove LLC”, “we”, or “us”). Your use of the Service constitutes your agreement to these terms and conditions (“Mobile Terms”). We may modify or cancel the Service or any of its features without notice. To the extent permitted by applicable law, we may also modify these Mobile Terms at any time and your continued use of the Service following the effective date of any such changes shall constitute your acceptance of such changes.

By consenting to Diggers Cove LLC's SMS/text messaging service, you agree to receive recurring SMS/text messages from and on behalf of Diggers Cove LLC through your wireless provider to the mobile number you provided, even if your mobile number is registered on any state or federal Do Not Call list. Text messages may be sent using an automatic telephone dialing system or other technology. Service-related messages may include updates, alerts, and information (e.g., order updates, account alerts, etc.). Promotional messages may include promotions, specials, and other marketing offers (e.g., cart reminders).

You understand that you do not have to sign up for this program in order to make any purchases, and your consent is not a condition of any purchase with Diggers Cove LLC. Your participation in this program is completely voluntary.

We do not charge for the Service, but you are responsible for all charges and fees associated with text messaging imposed by your wireless provider. Message frequency varies. Message and data rates may apply. Check your mobile plan and contact your wireless provider for details. You are solely responsible for all charges related to SMS/text messages, including charges from your wireless provider.

You may opt-out of the Service at any time. Text the single keyword command STOP to +18775104925 or click the unsubscribe link (where available) in any text message to cancel. You'll receive a one-time opt-out confirmation text message. No further messages will be sent to your mobile device, unless initiated by you. If you have subscribed to other Diggers Cove LLC mobile message programs and wish to cancel, except where applicable law requires otherwise, you will need to opt out separately from those programs by following the instructions provided in their respective mobile terms.

We may change any short code or telephone number we use to operate the Service at any time and will notify you of these changes. You acknowledge that any messages, including any STOP or HELP requests, you send to a short code or telephone number we have changed may not be received and we will not be responsible for honoring requests made in such messages.

The wireless carriers supported by the Service are not liable for delayed or undelivered messages. You agree to provide us with a valid mobile number. If you get a new mobile number, you will need to sign up for the program with your new number.

To the extent permitted by applicable law, you agree that we will not be liable for failed, delayed, or misdirected delivery of any information sent through the Service, any errors in such information, and/or any action you may or may not take in reliance on the information or Service.
